Head of Mureș County School Inspectorate, Ioan Macarie, said on Friday that based on the Order of the Minister of National Education, issued the day before, granting the temporary functioning permit to the Romanian Catholic Theoretical High School (LTRC) in Târgu Mureş , this school may work from September 15, but only if it has the required number of pupils.
“Ministry of Education issued an order for the provisional and practical authorization to establish the Roman Catholic Theological School” II Rakóczi Ferenc “in Târgu Mureş. From a technical point of view, the school could start, of course, if it has pupils. A question that I ask and must be considered in the most serious way (…) The Minister’s Order mentions 26 study formations, with 28 children, that is, 728 children. the school unit whose classes (grades, no) passed to the Bólyai Farkas Theoretical High School (after the abolition of the LTRC, no) means 250 children, because the 8th and the 12th grade came out. At this moment we are looking forward to seeing what proposals we have for the new director, we have also asked for a classification plan, because the teachers who taught at the former LTRC were transferred by posting to the Bolyai Farkas Theoretical High School and we asked for a situation of all or teachers. We are waiting for the number of students to be transmitted so we can include them in the SIR. (…) If he has the number of copies, he has enough teachers to begin with, we will see how, from an administrative point of view, “Ioan Macarie pointed out.
According to the head of County School Inspectorate Mureş, following the final sentence of the Târgu Mureş Court of Appeal of February 6, 2018, Decision no. 1385 / 31.08.2015 issued by County School Inspectorate Mureş to establish the Roman Catholic Theological High School in Targu Mures – which provided for the establishment of this school through the partial division of the Bólyai Farkas Theoretical Lyceum and the Unirea National College – was canceled and the students’ archives returned to initial schools.
“This means that all children have to return to their original form, and the sentence has to be applied by County School Inspectorate Mureş because it was a part of the trial.” County School Inspectorate Mureş, through the decision of the Board of Directors, ordered that the entire LTRC high school archive either to the Bólyai Farkas High School and the LTRC Primary and Gymnasium to be passed to the Unirea National College. This was what we had to do and did it in accordance with the legal provisions. either passed to the SIR and to our data base in the schools where they were before 31 August 2015. (…) Scriptically, the implementation of the Court of Appeal’s decision states that those pupils who were at LTRC should be enrolled at (Unirea and Bólyai, no.) At this time, children can not be transferred, they should express their choice as being another school unit, ” said Macarie.
He also said that the Order of the Minister specified that the Romano-Catholic Theological School “II Rakóczi Ferenc” from Târgu Mureş was established as a legal unit for all 26 study formations, which would involve 750 pupils.
“We will see who will send us the tables, how many children are, are some steps to follow, and the final term is September 1,” stressed Ioan Macarie.
The problems related to the functioning of the Roman Catholic Theological High School in Târgu Mureş occurred in November 2016 after the National Anticorruption Directorate started criminal investigation against the former head of the County School Inspectorate Mureş Ştefan Someşan and the former director of LTRC Târgu Mureş, Zsolt-József Tamási, for the way the school was set up.
Subsequently, the two were sued, the case being returned to the National Anticorruption Directorate.
In February this year, the Administrative Litigation Division of the Târgu Mureş Court of Appeal upheld the decision of the Mureş Tribunal, which annulled the decision issued by the County School Inspectorate, which established the Roman Catholic Theological High School in Târgu Mureş and the classes were transferred from this school unit to the two other educational institutions.
In the final decision, the Târgu Mureş Court of Appeal upheld the administrative appeal filed by the applicant in Târgu Mureş against the Mureş County School Inspectorate and the Roman Catholic Theological High School and annulled Decision no. 1385 / 31.08.2015 issued by County School Inspectorate Mureş.
Decision no. 1385 / 31.08.2015 issued by County School Inspectorate Mureş stipulates in Article 1 that, beginning with the school year 2015-2016, the Romano-Catholic Theological High School in Târgu Mureș is established by partial division of the Bólyai Farkas Theoretical High School and the Unirea National College.
In art. 2, this document provided that, starting with the date of issue of the document, the Roman Catholic Vocational Branch of Bolyai Farkas High School will be transferred to this newly established high school, as well as classes I-VIII with Hungarian language teaching at the Unirea National College.
At the beginning of the school year 2017-2018, based on the suspension of the decision to set up the LTRC, the students enrolled in this unit were assigned to the Theoretical High School “Bólyai Farkas” in Târgu Mureș.
In March this year, the Constitutional Court of Romania accepted the notification of the NLP and PMP, the draft law adopted by the Parliament regarding the establishment of the Roman Catholic Theological High School in Târgu Mureş being declared unconstitutional.
